The petitioners are apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under sections 420, 467, 468 and 471/34 of the Indian Penal Code. The prosecution case is that complainant's land was transferred by co-accused Madan Mohan Sah in favour of coaccused, Bachhan Prasad Singh. It is alleged that the petitioners were witnesses to the sale deed.

It is submitted by learned counsel for the petitioners that neither the sale deed was executed by the petitioners nor they are beneficiary under the same. A statement has been made in

Patna High Court Cr.Misc. No.54248 of 2015 (2) dt.30-11-2015 2/2 paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM, 1st, Sheikhpura in connection with Complaint Case No.39C of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
