The petitioners apprehend their arrest in Dulhin Bazar P.S. Case No. 51/2012, registered for the offence punishable under Sections 304B, 201 of the Indian Penal Code.
Chand Bihari Paswan the father of the deceased alleged that his daughter was done to death by her husband and other inlaws. It is submitted that the petitioners are brother and sisterin-law (Bhabhi) of the deceased. Petitioners are not named in the F.I.R., but the police obtained warrant of arrest against the petitioners without having any tangible evidence. It appears that petitioner no. 1 is the brother of the deceased, petitioner no. 2 is
Patna High Court Cr.Misc. No.1075 of 2016 (3) dt.29-06-2016 2/2 the wife of petitioner no. 1, but they have been made accused by the police without having any tangible evidence. Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Patna in connection with Dulhin Bazar P.S. Case No. 51/2012, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
