In the present case, the petitioner was holding the post of Deputy Superintendent, Chapra Hospital, Saran and has been transferred as Additional Chief Medical Officer, Buxar. Learned counsel for the petitioner submits that the petitioner has only six months left for his superannuation. At the same time, he has filed an application for Voluntary Retirement on the health ground but, instead of disposing of the same, he has been transferred as Additional Chief Medical Officer, Buxar and submits that as per the guideline issued by the State Government, if the government employee is going to retire within one year and he requests for his transfer and posting at the place of his choice, it should be considered sympathetically.

Patna High Court CWJC No.12952 of 2018 dt.27-07-2018 2/2 Learned counsel for the petitioner further submits that the petitioner wants to stay at Saran on two grounds, firstly he has filed an application for his retirement on the health ground and, secondly, only six months have left for his superannuation. In that view of the matter, for the present, the status-quo as on today will be maintained and the representation filed by the petitioner will be disposed of by the authority concerned. This order of status-quo will remain in operation till the final decision is taken by the State Government. With the aforementioned observation and direction, this writ application is disposed of.
