JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 05-02-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in connection with Sonepur P. S. Case No. 330 of 2015 registered under Sections 395, 397 and 120-B of the Indian Penal Code.

It is contended that the petitioner is neither named in the FIR nor any incriminating article was recovered from his conscious possession and though he is in custody since 21.08.2015, test identification parade has not been conducted so far.

Learned counsel for the State has opposed the prayer for bail. He has submitted that during investigation, the

Patna High Court Cr.Misc. No.53033 of 2015 (4) dt.05-02-2016 2/2 petitioner was apprehended after one week of the occurrence and on interrogation he had confessed his guilt. Regard being had to the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-4, Saran at Chapra in Sonepur P. S. Case No. 330 of 2015.
