JUSTICE RUDRA PRAKASH MISHRA ORAL ORDER 13-05-2025 Earlier vide order dated 19.02.2025, petitioner nos. 1 and 3 have already been granted bail. The present bail application survives only in respect of petitioner no. 2.
2. Heard learned counsel for the petitioner no. 2 and learned APP for the State. Perused the case diary.
3. The petitioner no. 2 seeks bail in connection with Dumraon P.S. Case No. 263 of 2024 instituted for the offences under Sections 80(2) of the BNS.
4. Prosecution case, in short, is that the petitioner no.2 alongwith the family members tortured and killed the deceased for the non-fulfillment of demand of dowry.

5. Learned counsel for the petitioner no.2 submitted that petitioner no.2 has falsely been implicated in the present case. Petitioner no.2 is the mother-in-law of the deceased. Learned counsel further submitted that petitioner nos. 1 and 3 who are father-in-law and sister-in-law of the deceased respectively, have already been granted bail. Learned counsel further submitted that general and omnibus allegation has been made against the petitioner no.2. No specific overt act is alleged against the petitioner no.2. Learned counsel further submitted that petitioner no.2 is separate in mess and business and has got no concern in the family affairs of the deceased and her husband. Learned counsel further submitted that husband of the deceased has already been granted bail by this Court vide order dated 24.04.2025 passed in Cr. Misc. No. 4445 of 2025. It has been submitted on behalf of the petitioner no.2 that the petitioner no.2 is in custody since 23.10.2024 and has no criminal antecedent.
6. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner no.2.
7. Considering the aforesaid facts and circumstances of the case, claim based on parity as also the period of custody undergone by the petitioner no.2, this Court is inclined to grant

8. Let the petitioner no.2 be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Dumraon P.S. Case No. 263 of 2024.
