JUSTICE MUNGESHWAR SAHOO ORAL ORDER 15-12-2015 Heard the learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner, namely, Rohit Kumar is in custody in Sadar P.S. Case No.338 of 2015 under Sections 25(1-B)a/ 26-II/35 of the Arms Act and Section 3⁄4 of the Explosive Substance Act and under Section 399, 402, 414/34 of the Indian Penal Code. The learned counsel for the petitioner submitted that from the possession of the petitioner, one country made pistol and cartridge has been recovered and he is in custody since 06.07.2015. From the possession of co-accused, Dilip also, one country made pistol and two cartridges were recovered who has already been granted bail by this Court in Cr. Misc. No.53957 of

Patna High Court Cr.Misc. No.55642 of 2015 (2) dt.15-12-2015 2015. Likewise, the other co-accused persons have also been granted bail in Cr. Misc. No.53768 of 2015, 47079 of 2015 and 45869 of 2015. According to the learned counsel, the case of this petitioner is on same footing as that of Dilip who has already been granted bail.

The learned A.P.P. does not dispute this fact. Considering the above facts that the co-accused has already been granted bail by this Court, I direct the petitioner named above to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali, Hajipur in connection with Sadar P.S. Case No.338 of 2015.
