Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Sitamarhi P.S. Case No.370 of 2018 registered under Sections 420, 467, 468, 471 and 188/34 of the Indian Penal Code.
The accusation is that regarding the running of clinic by the petitioner no.1 Kumari Rani alias Dr. Neelam Rani and
Patna High Court CR. MISC. No.10436 of 2019(5) dt.09-07-2019 2/3 the petitioner no.2 Neelmani alias Dr. Nilmani, the husband of the petitioner no.1, on the basis of the forged degree, Sitamarhi P.S. Case No.163 of 2017 was instituted under Sections 420, 467, 468, 471 and 474/34 of the Indian Penal Code. Later on, when the clinic of the petitioner no.2 was inspected, then the sealed lock of the clinic was found broken and 20 patients were present there, who disclosed that they are under the treatment of the petitioner no.2. One Prashant Nagmani, who was present inside the clinic, introduced himself to be the brother of the petitioner no.2. The work of the clinic was being done by the petitioner no.3 Birendra Singh.
Learned counsel for the petitioners submits that the petitioner no.3 is the qualified doctor and he obtained the M.B.B.S. Degree from D.M.C.H. in 1974 and after retirement from the Government Health Services, he is doing the work in the clinic of the petitioner nos.1 and 2, which is managed by them.
Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like
Patna High Court CR. MISC. No.10436 of 2019(5) dt.09-07-2019 3/3 amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Sitamarhi P.S. Case No.370 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
