Three cartridges are said to have been recovered from the conscious possession of the petitioner when police apprehended him and one other co-accused.

Admittedly, for kidnapping of Jitendra Kumar, a separate case has been registered against the petitioner and others and except the above stated kidnapping case as well as present case, there is no any other criminal antecedent of the petitioner. Considering the aforesaid facts and circumstances as well as alleged recovery, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri R. Ranjan, Judicial Magistrate, Ist Class, Naugachia District Bhagalpur in Ishmailpur P.S. Case no. 15/2014. However, it is made clear that release of the petitioner in the present case will not make any impact on the case registered against
