The petitioner has prayed for the following relief/s : "(i) For directing to the respondent authority to make payment of appropriate and correct compensation amount of the land in question with deviling house of the petitioner which has been acquired by the respondent authority bearing Thana No. 38 Mauza- Harpur Nijamat, Halka-Chaknoor, Khata No.05, Khesra No. 114 ( in which house of the petitioner is situated) and Khata No. 74, 17, 29, 56, 24 and 31 Khesra No. 114, 125, 78, 77, 76, 75, and 74, 79 District -Samastipur for the purpose of construction/widening of N.H. 119D within the District -Samastipur.

(iii) For direction to the respondent authority to re-assess the land of the petitioner acquired under the N.H.119D projects and treating the land to be as commercial in nature and pay compensation amount accordingly.

(iv) For direction to the respondent to pay adequate amount of statutory as well as penal interest over the compensation amount to the petitioner."

3. Learned counsel for the petitioner submits that the said land has been acquired for the construction/widening of NH-119D. Learned counsel further submits that in the Gazette Notification, which is attached as Annexure P/5 to the writ petition, the petitioner's name appears in relation to different plots, but not a single penny has been paid to him.

Learned counsel for the petitioner further submits that he has made several representations and his latest representation is dated 2012.2024, but no decision has been taken by respondent No.4, namely, the District Land Acquisition Officer, Samastipur, on petitioner's representation. In result, the petitioner is not in a position to get a single penny. Learned counsel further submits that since he failed to please the District

Patna High Court CWJC No.2493 of 2025(2) dt.20-02-2025 3/3 Land Acquisition Officer, Samastipur only due to this reason, he sat over the matter. The petitioner moved pillar to post, but his grievances could not be redressed.

Learned counsel for the petitioner further submits that he has made several representations, with the latest one dated 2012.2024, but no decision has been taken by respondent No. 4, namely, the District Land Acquisition Officer, Samastipur, on the petitioner's representation. As a result, the petitioner has not received a single penny. Despite moving from pillar to post, the petitioner's grievances have not been redressed.

In light of the submissions made, it is directed that the District Land Acquisition Officer, Samastipur, pass an order on the petitioner's representation, specifically mentioning the price of the land, the category of the land, and the compensation amount to be paid to him, within 60 days from the date of production/receipt of a copy of this order.

7. With the aforesaid observation and direction, this writ petition stands disposed off.
