The petitioner apprehends his arrest in Nauhatta P.S. Case No.161 of 2018 registered under Sections 341, 323, 307 and 34 of the Indian Penal Code and under Section 27 of the Arms Act.
The informant alleged that four persons came on two motorcycles and started hot talk with local people. When the informant asked them to leave the place, on which Sanoj Jha fired at the informant but the firing did not hit the informant. Learned counsel for the petitioner submits that there is no allegation against the petitioner. The petitioner has no manner of concern with Sanoj Jha and others. It is further submitted that the motorcycle recovered from the place of occurrence does not belong to the petitioner.

No.9108 of 2019(2) dt.15-02-2019 2/2 Having considered the fact that, of course, the petitioner is alleged to have accompanied other three accused persons but no specific allegation is made against him, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Saharsa in connection with Nauhatta P.S. Case No.161 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
