The petitioner seeks bail in connection with Salimpur P.S. Case No. 90 of 2019, registered under Sections 399, 402 and 413 of the Indian Penal Code and 25(1-b)a, 26 and 35 of the Arms Act.

The accusation is that in course of patrolling duty, informant received information about gathering of 8 to 10 miscreants with motorcycle near Peepal tree in village Hedayatpur, thereafter, informant along with other police personnel reached there. On seeing the police vehicle all started to flee away, but, on chase 8 miscreants, including the petitioner, were apprehended. On search, the petitioner was found in possession of mobile sets and cash of Rs.2,300/- while other coaccused, Ankit Kumar, was found in possession of country made

Submission is that the petitioner is in custody since 08.05.2019.

Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Salimpur P.S. Case No. 90 of 2019 to the satisfaction of Sri K.P. Arya, Judicial Magistrate, 1st Class, Barh, Patna, subject to the condition that out of two bailors, one must either be parent or close relative of the petitioner.
