The petitioner, Bogo Nut @ Mustaque Nut, seeks regular bail in G.R.P. Bakhtiyarpur (Fatuha) P.S. Case No.67 of 2014, registered under Sections 379 and 411of the Indian Penal Code.

The allegation against the petitioner is that he committed theft of Rs.30,000.00 from the pocket of Mithilesh Kumar, the informant, but the public caught him and Rs.30,000.00 was recovered.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent except one, that too of recovery of one motor part. Petitioner is in jail for four months. Perused the record.

Considering the facts and the nature of allegation

Patna High Court Cr.Misc. No.51912 of 2014 (2) dt.07-01-2015 2/2 made against the petitioner and the fact that the petitioner is in jail for last four months, his prayer for bail is allowed. The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Patna in connection with G.R.P. Bakhtiyarpur (Fatuha) P.S. Case No.67 of 2014, subject to the condition that one of the bailors shall be close relation/father/mother of the petitioner. (Prabhat Kumar Jha, J) Pawan/- U T
