The petitioner seeks bail in connection with Special Case No.1130 of 2020 arising out of Kursakanta (Sonamani Godam) P. S. Case No.244 of 2020, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
Altogether 108 litres of Nepali liquor is said to have been recovered from a motorcycle.
Learned counsel for the petitioner submits that petitioner is innocent and falsely implicated in this case. Petitioner was only the pillion rider of the said motorcycle. The petitioner is in custody since 28.12.2020 and he is a person with
Patna High Court CR. MISC. No.25703 of 2021(2) dt.17-11-2021 2/2 clean antecedents.
Learned A.P.P. vehemently opposes the bail prayer. Considering the facts afore-stated, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise Act, Araria in connection with Special Case No.1130 of 2020 arising out of Kursakanta (Sonamani Godam) P. S. Case No.244 of 2020.
The application stands allowed.
