The petitioner seeks bail in a case registered under section 364/34 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner was granted anticipatory bail vide order passed in Cri. Misc. No. 33638 of 2010 thereafter the petitioner and other accused persons filed Cri. Misc. No. 27958 of 2010 in which the further proceeding was stayed but on 19.07.2013 the same criminal miscellaneous petition was dismissed but the petitioner did not surrender in the court. The petitioner surrendered in the court on 03.11.2014 and since then he is in jail. Considering the fact that it is a case of misuse and for that the petitioner has remained in jail for more than two

No. 320 of 2007 arising out of Ladaniya P.S. Case No. 88 of 2003.
