JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-03-2020 Heard learned counsel for the petitioner and the State. The petitioner is apprehending arrest in connection with Hathauri P.S. Case No. 201 of 2019 for the offence under Section 30(a) of Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. He further submits that in the instant case 11 litres of country made liquor, kept in plastic gallon, was recovered from the hut and not from the possession of the petitioner.
Considering the fact that the petitioner has no criminal antecedent and nothing was recovered from the conscious possession of the petitioner, the Court is inclined to grant bail to petitioner, in the event of arrest or surrender within four weeks

No.8035 of 2020(2) dt.02-03-2020 2/2 from today, on furnishing bail bond of Rs. 50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-cum-Special Judge, Excise, Samastipur in connection with Hathauri P.S.
