JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 16-03-2016 The learned counsel for the petitioner submits that due to typographical mistake name of the police station case has been wrongly mentioned in the petition and he seeks permission to correct the same.
Permission is granted. Let the same be corrected during course of the day.
Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.
The petitioner seeks bail in a case for the offences punishable under sections 406, 420, 504 and 120 (B)/34 of the I.P.C The petitioner and other FIR named accused persons in collusion and conspiracy after opening the private Bank,
Patna High Court Cr.Misc. No.2094 of 2016 (3) dt.16-03-2016 2/3 namely, Ambition Agro Activation India Limited cheated the informant and defalcated the amount of Rs. 2,65,850/-. The other persons have also been cheated.
Submission is of false implication and that the petitioner, his brother Raj Kumar Ram were employed as fourth grade employee in the said private Bank, the amount deposited has already been returned to the informant and other persons and accordingly compromise petition was filed in the court below and on that basis Raj Kumar Ram, the brother of the petitioner, has been allowed bail by order dated 19.02.2016 in B.P. No. 174 of 2016 from the court of the Additional Sessions Judge-I, Katihar. The learned A.P.P. fairly submits that in view of the compromise lenient view can be taken.
In the facts and circumstances as stated above, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Katihar in Katihar Nagar (Sahayak) P.S. Case No. 349 of 2014, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive
Patna High Court Cr.Misc. No.2094 of 2016 (3) dt.16-03-2016 3/3 dates on his part without any reason shall disentitle the petitioner from privilege of bail.
