2. The petitioners apprehend their arrest in connection with Nath Nagar P.S. Case No. 580 of 2023, registered for the offences punishable under Sections 341, 323, 325, 307, 379, 504, 506/34 of the Indian Penal Code.

3. As per allegation, the FIR named accused persons came to the land of the informant and started putting Tatiya on the said land. Petitioner no. 1, assaulted the informant's mother Daya Devi, on her head and hand by means of lathi, due to which, she sustained injureis.

4. The learned counsel for the petitioners has submitted that the petitioners have falsely been implicated in this case.

5. Since there is specific allegation against the Petitioner no. 1 to assault the informant's mother on her hand and head and hence, he does not deserve the privileges of anticipatory bail and accordingly, his prayer for bail is rejected.

So far as petitioner no. 2 is concerned, there is no specific allegation against him to assault the informant and on similar footing other accused persons have been granted anticipatory bail by the co-ordinate Bench in Cr. Misc. No. 76740 of 2023, let petitioner no. 2, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Nath Nagar P.S. Case No. 580 of 2023, subject to condition as laid down under section 438(2) Cr. P.C.
