The petitioner seeks bail in connection with Vigilance P.S. Case No.070 of 2010 registered under Sections 467, 468, 447(A), 120(B), 420 and 201 of the Indian Penal Code besides Sections 7/13 read with Sections 13(1)(d) of the Prevention of Corruption Act.

The accusation is that the Land Acquisition Officer and Assistant demanded the share on the payment of compensation. During the course of inquiry, it has come that one Ramashish Yadav got the bank accounts of the beneficiaries opened and kept their pass-books with him and taking the opening-depositing form

Patna High Court Cr.Misc. No.48409 of 2015 (2) dt.09-11-2015 2/2 of the account by this petitioner from the Bank took Rs.3,10,000/- as bribe by withdrawing the amount from the account of the beneficiaries.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that there is no allegation of taking bribe against the petitioner rather it has only come during the course of inquiry that this petitioner had supplied the opening and depositing form to the co-accused Ramashish Yadav. Further submission is that the petitioner having no criminal antecedent is in custody since 22.09.2015. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Vigilance-II, Patna, DistrictPatna, in connection with Vigilance P.S. Case No.70 of 2010(Special Case No.26 of 2010).
