11-07-2018 Learned counsel for the petitioner submits that in fact due to typographical mistake committed in the prayer portion in the petition the correct description of the court, to whom satisfaction and sureties are to be submitted, could not be provided, as a result of which, in the order dated 09.05.2018, the complete description of the court has not been mentioned.
Learned counsel submits that the surety bond and the other undertaking are to be submitted in the court of learned A.C.J.M., Hilsa in the District of Nalanda. In the order dated 09.05.2018 the name of the place 'Hilsa' has not been mentioned because the same was not mentioned in the
Patna High Court Cr.Misc. No.41249 of 2018 (2) dt.11-07-2018 prayer portion.
Considering the nature of submission, let the order dated 09.05.2018 passed in Cr.W.J.C. No. 1098/2018 be read as if it pertains to the court of learned A.C.J.M., Hilsa in the district of Nalanda. The petitioner would fulfill the conditions mentioned in the said order to the satisfaction of learned A.C.J.M., Hilsa in the district of Nalanda whereupon the order dated 09.05.2018 shall be given effect to.
This modification application stands disposed off.
