This Court vide order dated 26.09.2016 passed in C.W.J.C. No.12453 of 2013, has given direction to the respondents to consider the entitlement of the petitioner regarding up-gradation of pay as well as promotion. The Director, Social Security and Disability, vide order dated 05.05.2017 rejected the claim of the petitioner and recorded the finding that he has already been granted the upgradation of the pay on two occasions, and as such, he is not entitled to A.C.P. or M.A.C.P.

In such view of the matter, this Court is not inclined

Patna High Court MJC No.376 of 2017(2) dt.11-07-2018 2/2 to proceed further in the matter. Accordingly, this contempt proceeding is dropped. The petitioner, if so like, may take legal action against the order dated 05.05.2017.
