JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the informant and he is in jail custody since 22.09.2015 in a case registered under sections 341, 323 and 498A of the Indian Penal Code. It has specifically been pleaded that prior to institution of the present case, the informant had filed three other cases including one case under section 498A of the Indian Penal Code and almost in all the above stated cases, trail of the petitioner was going on and it is also pointed out that petitioner had filed a suit for restitution of conjugal right in the year 2010, which was
Patna High Court Cr.Misc. No.54858 of 2015 (2) dt.09-12-2015 2/2 decreed in the year 2011 and the informant was directed to lead her conjugal life with the petitioner but the informant is not interested to lead her married life with the petitioner. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah, West Champaran in connection with Nautan P.S.Case No. 320 of 2015.
