JUSTICE AHSANUDDIN AMANULLAH ORAL JUDGMENT Date: 23-07-2018 Heard learned counsel for the petitioner; State and Veer Kunwar Singh University (hereinafter referred to as the 'University').

2. The petitioner has moved the Court for the following reliefs:

"That the present writ application is being filed for issuance of appropriate writ/writs, direction or directions to the Respondent Authorities to pay the post retiral dues of the petitioner with interest who has been retired from the post of Routine Clerk on 30.11.2016 from the Maharshi Vishwamitra

Patna High Court CWJC No.17137 of 2017 dt.23-07-2018 2/2 College, Buxar and/or any other relief or reliefs to which the petitioner may be found entitled encourse of hearing of this writ application."

3. Two counter affidavits have been filed on behalf of the University (respondents no. 4 to 7) in which the stand taken is that all admitted retiral dues of the petitioner have been paid. In support thereof, a chart has also been annexed.

4. Since copy of the affidavit was served on learned counsel for the petitioner on 18.07.2018, as prayed for by him, the matter was adjourned for today. Today, no rejoinder has been filed.

5. Having regard to the aforesaid and taking note of the fact that the averments of the University that the admitted retiral dues of the petitioner have been paid, not being controverted or rebutted, the Court can only presume that the same have been paid.
