JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2020 Petitioner seeks regular bail in connection with Fulkaha P.S. Case No. 189 of 2019 corresponding to Special Case No. 1592 of 2019 registered for the offence punishable under Sections 30(a), 41 (I), 45 of the Bihar Prohibition & Excise Act, 2016.

Petitioner was caught on chase by the police, driving on the motorcycle one succeeded in fleeing away and more than 100 liters of illicit liquor was recovered from the motorcycle and near huge quantity of liquor was also found. Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case. He has no concern with the seized liquor. He is in custody since 23.11.2019, having no criminal antecedent. Charge-sheet has already been submitted, there is no chance of tempering with the

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise Araria, in connection with Fulkaha P.S. Case No. 189 of 2019 corresponding to Special Case No. 1592 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
