JUSTICE SUDHIR SINGH ORAL ORDER 18-03-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 406, 420, 504 and 34 of the Indian Penal Code.
Allegation against the petitioners is that they have not paid Rs.5,24,000/- to the informant for construction work done by him(informant) in the factory of the petitioners. It is submitted on behalf of the petitioners that they have falsely been implicated in the present case. It is further submitted that they are ready to deposit an amount of Rs.1,50,000/- in the court below which may be released in favour of the informant. On behalf of the State and the informant, it is submitted that petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that petitioners shall deposit an amount of Rs.1,50,000/- in the court below which may be released in favour of the informant.
Let the above named petitioners, in the event of arrest or surrender in the court below within a period of eight weeks, be
Patna High Court Cr.Misc. No.5522 of 2016 (2) dt.18-03-2016 2/2 released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of Sri P. K. Ratan, learned Judicial Magistrate, Ist Class, Patna City, in connection with Fatuha P.S. Case no. 339 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
