The petitioner apprehends his arrest in connection with Udwant Nagar P.S. Case No. 280 of 2015 registered for offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 47(A) of the Excise Act.
It is submitted on behalf of the petitioner that he has nothing to do with the place from where allegedly countrymade liquor and jaggery etc. have been found. It is contended that the property belongs to one Hridya Yadav but he has neither been made accused nor has his statement been recorded to show that he had rented the property to the petitioner. It is further stated that petitioner was not apprehended from the spot as he was out of
Patna High Court Cr.Misc. No.1100 of 2016 (2) dt.12-01-2016 2/2 station at that point of time.
Having regard to the facts and circumstances of the case, let the petitioners, namely Muna Keshari @ Munna Keshri be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Udwant Nagar P.S. Case No. 280 of 2015, on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Ara, subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
