2. Earlier prayer for bail of the petitioner was rejected by order dated 03-07-2024 in Cr. Misc. No. 45728 of 2024.

3. It has been submitted that though application for bail of the petitioner was earlier rejected by order dated 03-072024 in Cr. Misc. No. 45728 of 2024 but his case is on similar footing to that of co-accused Sheo Shankar Paswan who has been granted bail vide order dated 27-09-2024 in Cr. Misc. No. 39479 of 2024. Learned counsel for the petitioner has further submitted that while rejecting the bail petition of the petitioner in Cr. Misc. No. 45728 of 2024, it has been mentioned that the

No.11101 of 2025(3) dt.12-05-2025 2/2 petitioner has deliberately concealed his criminal history but as a matter of fact, he has not concealed his criminal antecedent because he was involved in only two other cases except the present one, which are Phulparas P.S. Case No. 168 of 2020 and Phulparas P.S. Case No. 131 of 2020. He has mentioned both the cases in paragraph-3 of the bail petition. So far Phulparas P.S. Case No. 159 of 2013 is concerned, the petitioner was not accused in that case. He has filed certified copy of Phulparas P.S. Case No. 159 of 2013 as Annexure-5 which shows that he was not involved in that case.

4. Learned counsel appearing for the State and the informant have opposed the prayer for bail.

5. Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Jhanjharpur, Madhubani in connection with Phulparas P.S. Case No. 597 of 2023.
