JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Town P.S. Case No. 737 of 2018, registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.
Prosecution case as per FIR is that dead body of brother of the informant was found in a ditch and he suspects the petitioner and other accused persons due to property dispute and earlier the deceased was threatened by them, that they might have killed him.
Submission of learned counsel for the petitioner is that except suspicion nothing has come against the petitioner during investigation and he has falsely been implicated in this case.

No.12656 of 2019(3) dt.30-04-2019 2/2 Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran, Chapra, in connection with Town P.S.Case No. 737 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further condition is that petitioner has to co-operate in the investigation, otherwise his bail bonds shall be cancelled.
