2. The petitioner seeks bail in connection with Dumraon P.S. Case No. 235 of 2019, instituted for the offences punishable under Sections 120(B), 307, 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. The prosecution case, in short, is that two unknown persons came to the informant's shop in search of him and shot his staff, Bharat Sah, causing injuries, when his whereabouts were not disclosed. It is further alleged that the attack was sponsored by co-accused Chandan Gupta following his earlier extortion demand and threat.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the

No incriminating material has been recovered from the conscious possession of the petitioner. Learned counsel for the petitioner also submits that the petitioner is not named in the FIR. Name of the petitioner has transpired in this case on the basis of confessional statement made by co-accused, namely Chandan Gupta and the same has got no evidentiary value. It is next submitted that the petitioner was not present at the place of occurrence. The allegation levelled against the petitioner is general and omnibus in nature. The petitioner is in custody since 27.03.2024 and has got eight criminal antecedents.
5. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner.

On perusal of the report dated 06.05.2026, sent by the learned Trial Court, it transpires that charge has been framed against the petitioner on 01.08.2024 and five charge-sheeted witnesses are yet to be examined. It is further reported that the trial is likely to be concluded within a period of six months.
7. Considering the aforesaid facts and circumstances of the case, present stage of the case and taking into account the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

8. Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Dumraon P.S. Case No. 235 of 2019, subject to the following conditions: (I) One of the bailors shall be own/close member of the family of the petitioner.
(II) The petitioner shall appear on each and every date fixed at the trial and shall not remain absent on two consecutive dates without sufficient cause.
(III) The petitioner will not tamper with the evidence or the witnesses during the trial.
(IV) Petitioner shall not commit offence of similar nature in future.
(V) The petitioner shall not leave the territorial jurisdiction of the learned Court below without taking prior permission of the Court concerned.
If any of the above conditions are violated, the Trial Court shall be at liberty to cancel the bail bonds of the petitioner.
