This application has been filed by the petitioner for cancellation of anticipatory bail granted to the opposite party Nos. 2 & 3 by order dated 14-07-2020 passed in Cr. Misc. No. 15854 of 2020.

Learned counsel for the petitioner submits that the O.P. Nos. 2 & 3 were last seen with the deceased and thus, the anticipatory bail granted to them be cancelled. It is pertinent to record here that merits of the case cannot be a ground for cancellation of Bail.

Therefore, in view of the aforesaid coupled with the laid down in the case of Dolat Ram vs. State reported in (1995) 1 SCC 349, I find no reason to cancel the anticipatory bail granted to opposite party Nos. 2 & 3.
