The petitioner seeks bail in connection with Bettiah (Town) P. S. Case No.220 of 2020, instituted for the offences under Sections 341, 323, 324, 307, 504, 506/ 34 of the Indian Penal Code As per the prosecution case, this petitioner and two other accused persons assaulted one Laxman Prasad by knife on his head causing five incised injuries to him. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He submits that sudden casual marpit took place between the parties and there was no intention to kill the injured.

Similarly situated coaccused has already been allowed bail by a co-ordinate bench of this Court vide order passed in Cr.Misc.No. 25731/2021. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, West Champaran, Bettiah in Bettiah town Police Station Case No. 220 of 2020.
