In the aforesaid circumstance, this petition is being disposed of on merit with consent of the parties. Heard learned counsel appearing for the petitioner as well as learned A.P.P. for the State.

Petitioners are in jail custody since 7.9.2019 in connection with Jayangar P.S. Case No. 437/2019 registered under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.

Petitioner is not named in the first information report and paragraph 55 of the case diary shows that the name of petitioner came in confessional statement of co-accused

Patna High Court CR. MISC. No.7974 of 2020(3) dt.19-03-2020 2/2 Abhishek Mishra and except the aforesaid confessional statement, there is nothing against the petitioner, who does not have any criminal antecedents, which appears from perusal of para 3 of the petition.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Madhubani in connection with Jayangar P.S. Case No. 437/2019.
