JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-03-2020 Heard learned counsel appearing for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Akbarpur P. S. Case No.322 of 2019 registered for the offences punishable under Sections 341, 323, 498(A)/34 of the I.P.C. and Section 3⁄4 of the D. P. Act.

Petitioner no.1 happens to be the married Nanad of informant and so far as petitioner no.2 is concerned, he happens to be husband of petitioner no.1. It is alleged that petitioners also participated in assaulting the informant, her brother and mother.

Submission on behalf of the petitioners is that

Patna High Court CR. MISC. No.10438 of 2020(2) dt.03-03-2020 2/2 petitioners reside separately from other F.I.R. named accused. Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within six weeks from the date of receipt of this order to the Court concerned, shall be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Nawada in connection with Akbarpur P. S. Case No.322 of 2019, subject to conditions as laid down under Section 438(2) of the Cr.P.C. (Hemant Kumar Srivastava, J) vikash U T
