The petitioner has preferred this application for grant of regular bail in a case registered under section 365 of the Indian Penal Code to which sections 302 and 201 of the Indian Penal Code was added subsequently.

As per the prosecution case, the brother of the informant was taken away by accused Fantush Kumar and, thereafter, the informant was unable to contact him even on telephone.

It is submitted by learned counsel for the petitioner that the petitioner is not named in the FIR. The name of the petitioner transpired in course of investigation wherein it is

Patna High Court CR. MISC. No.20685 of 2021(3) dt.22-10-2021 2/2 stated that the petitioner was also involved along with the FIR named co-accused in the murder of Santosh Kumar Yadav. It is submitted that there is no eye witness to the occurrence. The FIR was registered after a delay of 5 days. Chargesheet has been submitted in the case. The petitioner is in custody since 15.10.2020 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the material on record and the petitioner having remained in custody for over 1 year, the petitioner is directed to be enlarged on bail in connection with Murliganj P.S. Case no. 55 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura.
