JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 01-02-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek bail in connection with Aurangabad Town P.S.Case No.374 of 2015 registered under Sections 414 of the Indian Penal Code as well as Sections 2(E), 3(8), 15 and 18 of the Mahaua Flower Act.

It is contended that the ingredients of the offence punishable under Section 414 of the Indian Penal Code are not attracted in the present case. The petitioners being men of clean antecedent are in custody since 7.9.2015. It is further contended that on completion of investigation the police have submitted their

Patna High Court Cr.Misc. No.52931 of 2015 (2) dt.01-02-2016 2/2 report under Section 173(2) of the Code of Criminal Procedure in the court and, hence, there is no chance of tampering with the evidence.

Learned counsel for the State has opposed the application for bail to the petitioners.

Regard being had to the nature of allegation as also the other facts and circumstances of the case, the above named petitioners are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad Town P.S. Case No.374 of 2015.
