The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 216 litres of IMFL was recovered from a Bolero pick-up van.

It is submitted by learned counsel for the petitioner that the petitioner happens to be a 62 year old lady. She has been falsely implicated in the case only for the reason that she happens to be the registered owner of the alleged pick up van. She is in custody since 28.12.2020, has no criminal antecedent and investigation in the case has concluded.

Heard learned A.P.P. for the State.

No.20555 of 2021(2) dt.06-09-2021 2/2 Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner not having any criminal antecedent and the period in custody, the Court directs the petitioner to be enlarged on bail in connection with Singheshwar P.S. Case no.169 of 2020(Excise Case no.430 of 2020) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum-Special Judge, Excise, Madhepura.
