The petitioners apprehend their arrest in Complaint Case No.787(C) of 2018 registered under Sections 341, 323, 494 and 498A of the Indian Penal Code and under Section 3⁄4 of the Dowry Prohibition Act.

The complainant alleged that she was married to Kumar Sushant on 09.06.2014 but when she went to matrimonial house, her husband, father-in-law and mother-inlaw subjected her to physical and mental torture and demanded Rs.4 lacs. When she came to her parents' house, the husband filed Matrimonial Case No.761 of 2016. After receiving notice,

Patna High Court Cr.Misc. No.10192 of 2019(2) dt.20-02-2019 2/2 she appeared in the court and became ready to go along with her husband but her husband continued to torture her. She informed the Delhi Police who came and intervened in the matter. Learned counsel for the petitioners submits that the petitioners are father-in-law and mother-in-law of the complainant. The wife was residing with her husband at Delhi and she fled away. Both petitioners are suffering from various old age disease.

Having considered the facts and the nature of allegation against the petitioners and the fact that the petitioners are father-in-law and mother-in-law of the complainant, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Patna City in connection with Complaint Case No.787(C) of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
