3. Mr. Vikash Kumar, learned SC-11 has filed counter affidavit on behalf of Respondent No. 1 and Respondent No. 2. Statements made in paragraph '11' of the counter affidavit filed on behalf of Respondent No. 2 have been placed before this Court to submit that this writ application has become infructuous. It is submitted that in Memo No. 1363 dated 24.09.2022, the Collector-cum-District Magistrate, Patna has recorded that the hotel/restaurant is being released from the

Patna High Court CWJC No.3162 of 2022(5) dt.13-08-2025 2/2 auction towards confiscation.

4. Having regard to the aforementioned position, we find that this writ application has become infructuous. Perhaps for that reason, learned counsel for the petitioner is not taking interest in the matter.

5. This writ application is dismissed.
