The petitioner is languishing in custody since 23.05.2014 in a case registered for the offences punishable under Sections 302 and 394 of the Indian Penal Code. Informant Dinesh Choudhary alleged that his son was coming from Delhi by Likchiwi Express train when unknown criminals robbed and thereafter killed him. The name of the petitioner sprang up on the confession of co-accused Sanjit Kumar @ Amit Kumar @ Mintu and Chintu. Subsequently the petitioner also alleged to have confessed.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.1855 of 2015 (02) dt.16-01-2015 2/2 petitioner that except the confession before police there is nothing against the petitioner and other similarly situated accused Md. Ashirf has been granted bail vide Cr. Misc. No. 31604 of 2014. Though the petitioner is accused in three other cases but he was not named in those cases and is on bail and all three cases. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class (Railway), Samastipur in connection with GRP (DAR) P.S. Case No. 07 of 2014.
