JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 16-12-2015 Heard learned counsel for the petitioner and learned A.P.P. representing the State.

The petitioner wants to renew his prayer for bail in connection with Katoria P.S. Case No. 53 of 2014 registered for the offences punishable under Sections 147, 148, 149, 341, 326, 307 and 302 of the IPC which was earlier rejected vide order dated 24.12.2014 by this Court passed in Criminal Misc. No. 32099/14 on the ground that similarly situated other co-accused Pappu Yadav @ Pappu Kumar Yadav, Suchit Yadav and Thakur Yadav have already been allowed bail and the petitioner by remaining in custody since 03.04.2014, has been sufficiently penalized. The learned A.P.P. is not in a position to distinguish the case of the petitioner.

No.52898 of 2015 (2) dt.16-12-2015 2/2 In the facts and circumstances stated above, the petitioner, Sahdeo Yadav is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned 1st Addl. District Judge, Banka in S.Tr. No. 716 of 2014 arising out of Katoria P.S. Case No. 53 of 2014 subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
