JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-02-2019 This application, for grant of anticipatory bail, arises out of Kathaiya P.S. Case No. 259/18, disclosing offences under Sections 341, 342, 324, 307, 302, 120B/34 of the Indian Penal Code.
Allegation against the petitioners and others is of assault to the husband of the informant and specific allegation against the co-accused Amarjeet Mahto, who assaulted the husband of the deceased by means of knife causing injury to him, who later on succumbed to his injuries.
Submission of learned counsel for the petitioners is that all the petitioners are ladies and have falsely been implicated in this case and no specific allegation has been

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -II, (West ), Muzaffarpur, in connection with Kathaiya P.S. Case No. 259/18, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is further subject to the condition that they will cooperate in investigation of the case and will appear as and when required by the police, except on showing genuine reasons.
