JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-01-2016 Petitioner being mother of the husband of the victim is apprehending her arrest in a case protest-cumcomplaint case wherein processes were directed to be issued after cognizance being taken for the offences punishable under Sections 304B of the Indian Penal Code.

The prosecution case is of killing the daughter of the complainant after fourteen years of marriage for nonfulfilment of dowry demand. It is submitted by learned counsel for the petitioner that on conclusion of the investigation the final form was submitted as mistake of fact and subsequently it was accepted but on protest-cum-complaint the processes have been directed to be issued.

Considering the fact that on conclusion of the

No.1531 of 2016 (2) dt.12-01-2016 2/2 trial petitioner was not sent up for trial and petitioner being lady, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sheikhpura in connection with Complaint Case No. 223(C) of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
