1. Heard the parties.
2. The petitioner apprehend his arrest in connection with Ara Nawada P.S. Case No.58 of 2017, registered for the offence punishable under Sections 302 of the Indian Penal Code.
3. The allegation against the petitioner is that the petitioner is involved in the murder of the sister of the informant.
4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and have committed no offence. He has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. Petitioner is not named in the FIR, he has
Patna High Court CR. MISC. No.9829 of 2023(4) dt.17-07-2023 2/2 been made accused in the present case on the basis of suspicion and also because he is the husband of the deceased. Petitioner has no criminal antecedent.
5. Learned APP for the State opposed the prayer for anticipatory bail by submitting that the petitioner, being the husband of the complainant/informant was bound to ensure the safety and dignity of the complainant/informant at her matrimonial house. It is also submitted that in the post-mortem report, it has came that several signs of injury has been found on the body of the deceased.
6. Having regard to the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected.
