2. The petitioner seeks bail in connection with Dhangai P.S. Case No. 61 of 2024 instituted for the offences under Sections 304B/34 of the Indian Penal Code.
3. As per prosecution case, the accusation against the accused persons including the petitioner is of killing the Informant's daughter by strangulating her neck due to nonfulfillment of dowry demand.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence as alleged against her and has falsely been implicated in the present case. The petitioner is the Gotni of the deceased and has been living separately from the bridegroom and, thus, the petitioner has no

Learned counsel for the petitioner further submits that Para 5, 6, 7 & 8 of the case diary, the witnesses have stated that they heard the deceased being killed by her husband by Duppatta by tiding in her neck. The husband of the deceased Guddu Kumar has voluntarily surrendered on 28.06.2024 in the court below and since then, he is in judicial custody. The petitioner is a lady and is the mother of three children. There is no direct or specific allegation of any overt act against the petitioner rather the same is general and omnibus in nature. The petitioner has no concern with the alleged occurrence. The petitioner has no criminal antecedent and is languishing in judicial custody since 08.12.2024 without any rhymes or reason.
5. Learned counsel for the petitioner again submits that the co-accused namely Sharda Devi has been granted bail by this Court vide order dated 10.01.2025 passed in Cr. Misc. No. 89933 of 2024. Co-accused Muniya Devi @ Muni Devi has also been granted bail by this Court vide order dated 13.11.2024 passed in Cr. Misc. No. 79726 of 2024.
6. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner, stating that the offence alleged against the petitioner is serious

Having heard rival contention of both the parties and considering the entire facts and circumstances of the case, the period of custody of the petitioner, the petitioner having no criminal antecedent as also the petitioner being lady, let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Dhangai P.S. Case No. 61 of 2024. (Rudra Prakash Mishra, J) rishi/- U T
