2. The petitioner apprehends his arrest in connection with Ishipur Barahat P.S. Case No. 43 of 2023 for the offence registered under Sections 341, 323, 504, 506, 379, 307 and 34 of the Indian Penal Code lodged on 03.03.2023 by the informant Anup Kumar.

3. This petitioner earlier moved in Cr. Misc. No. 47482 of 2023 which was taken upon 11.08.2023 and after some argument Mr. Jitendar Narayan Sinha who then appeared in the case withdrew the petition with submission that the petitioner shall be surrendering within four weeks, and accordingly, the same was rejected with a direction to the learned Court to

Patna High Court CR. MISC. No.13766 of 2024(2) dt.10-04-2024 2/2 dispose of his bail application, if he surrenders within four weeks on the same day. 8 months later, another anticipatory bail application has been filed. The case is amongst other under Section 307 and 34 of the Indian Penal Code and allegation against this petitioner and others is of assaulting the informant causing injury on his head as also that of his feet.

4. This Court has seen the paragraph-3 and he has criminal antecedent of the same nature.

5. This is second attempt which is accordingly rejected.

6. The Senior Superintendent of Police (S.S.P), Bhagalpur shall submit a report how the petitioner is filing anticipatory bail, one after another, without being taken into custody in a case lodged amongst other under Section 307 and 37 of the Indian Penal Code.

7. A report be submitted within four weeks from today.

8. Let a copy of this order be sent to the Office of S.S.P., Bhagalpur for his perusal and needful. (Rajiv Roy, J) Guddu/- U
