14-12-2015 Heard Sri Ranjan Kumar Jha, learned counsel for the petitioner and learned Addl. Public Prosecutor. The petitioner, who is in custody since 20-07-2015 in Kotwali (Barari) P.S. Case No. 435 of 2015 registered for the offence under Sections 457, 380, 411 of the Indian Penal Code, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that the petitioner is having clean antecedent and he has already suffered, keeping in view the fact that he is in custody since the month of July, 2015. He submits that recovery of two stolen mobile phone was shown from possession of the petitioner. Learned Addl. Public Prosecutor has opposed the prayer for bail. He submits that on chase, the petitioner was

Be that as it may, keeping in view the nature of accusation, period of custody and clean antecedent, let the petitioner namely Ganpat Yadav @ Ganpat Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur/concerned court in connection with Kotwali (Barari) P.S. Case No. 435 of 2015.
