The petitioner seeks bail in anticipation of his arrest in connection with Ariyari P.S. Case No. 36 of 2020 dated 11.03.2020 instituted for the offences under Sections 341, 323, 325, 307, 504, 506, 448 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner is said to have fired at the husband of the informant, who has received injuries on his elbow. In view of the gun-shot injury on the person of the victim, which is attributed to the petitioner, I am not inclined to grant anticipatory bail to him notwithstanding the fact that there is family dispute between the parties.

Accordingly, the prayer for anticipatory bail is

Patna High Court CR. MISC. No.20056 of 2021(3) dt.28-04-2022 2/2 rejected.

However, if the petitioner surrenders before the court below and seeks bail, his application shall be considered on its own merits and shall pass necessary order in accordance with law without being prejudiced by the fact that the present petition on his behalf has not been entertained.
