The petitioner, who is in custody since 6.8.2015 in connection with Ballia P.S. Case No. 291 of 2015 registered for the offence punishable under Section 399 , 402 of the Indian Penal Code and Section 25(1-b)a, 26, 35 of the Arms Act has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that petitioner was detained on an allegation of recovery of one loaded country made pistol with one live cartridge. He submits that besides the present case, the petitioner was made accused long back in the year 2006 in Ballia P.S. Case No. 150 of 2006. Be that as it may, keeping in view the nature of

No.52960 of 2015 (2) dt.15-12-2015 2/2 accusation and the period of custody, let the petitioner Uday Mishra be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Ballia P.S. Case No. 291 of 2015 with condition that one of the bailors must be blood relation of the petitioner and secondly during the trial the petitioner shall remain physically present before the court below on each and every date. If continuously on two dates the petitioner fails to appear without prior permission of the trial court his bail bond shall stand automatically cancelled.
