The petitioner seeks bail in connection with Anti P.S.Case No.29 of 2015 registered under Sections 302 read with 34 of the Indian Penal Code as well as Section 27 of the Arms Act. It is contended that from perusal of the FIR itself it would appear that co-accused Ranjit Kumar and Prakash Kumar, had fired at the brother of the informant, who sustained bullet injury on his chest as a result of which he died. It is further contended that the name of the petitioner has been given simply because he happens to be brother-in-law of co-accused Prakash Kumar.
Learned counsel for the State has opposed the
Patna High Court Cr.Misc. No.52962 of 2015 (3) dt.01-02-2016 2/2 application for bail.
Regard being had to the facts and circumstances of the case, petitioner, namely, Shailesh Kumar, reported to be a man of clean antecedent, who is in custody since 15.6.2015, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Anti P.S.
