JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 01-02-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek bail in connection with Banka P.S.Case No.592 of 2015 registered under Sections 384 and 386 read with 34 of the Indian Penal Code.

It is contended that the present case is out and out a false case as no occurrence as alleged by the prosecution has taken place. The alleged demand of ransom is said to be made on 7.9.2015, but the FIR was instituted on 19.9.2015, which goes to show the falsity of the case and cause of delay has not been explained. It is further contended that the informant and the petitioners are own agnates and their common ancestor was one

Learned counsel for the State has opposed the application for grant of bail to the petitioners. Regard being had to the facts and circumstances of the case, the petitioners, namely, Ramesh Yadav and Prem Yadav, who are reported to be men of clean antecedent and are in custody since 26.9.2015, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No.592 of 2015.
