JUSTICE SHIVAJI PANDEY ORAL ORDER 04-03-2015 Heard learned counsel for the petitioner and the State. In this case, petitioner is seeking bail in Pachrukhi P.S.Case No. 322 of 2013 registered u/s 341, 323, 324, 307, 504/34 IPC.
This is a case of free-fight from both sides as both sides caused injury to each other.
Allegation against the petitioner is to have caused injury by Farsa on the abdomen of Birendra Singh, husband of the informant.
Co-accused Arvind Singh who is alleged to have caused dagger blow in the abdomen of husband of the informant has been granted bail vide Cr. Misc.No. 16377 of 2014. Claim has been made that the case of petitioner stands on similar footing as
Patna High Court Cr.Misc. No.2523 of 2015 (3) dt.04-03-2015 2/2 that of Arvind Singh who has been granted bail. Petitioner is in custody since 8th August 2014.
In the facts and circumstances of the case, petitioner Rajesh Singh is directed to be released on bail on his furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in Pachrukhi P.S.Case No. 322 of 2013, subject to the condition that the petitioner would co-operate in the proceeding and if the petitioner will fail to co-operate in the proceeding of the court below and will remain absent for two consecutive dates without reasonable explanation, the court below will pass appropriate order, including cancellation of bail bonds.
